Appealing against orders of the district department of the regional akimat

May, 2022 – July, 2022 – appeal of the orders (hereinafter – Order) of the district department of one region akimat to suspend the contracts of two subsoil users for 6 months. At the same time in these Orders, the state body indicated the need to eliminate the violation, which is irremovable – violations of the sanitary protection zone by the enterprises, which, as it turned out, were violated by the residents of nearby houses.

The suspension of the contracts and, as a consequence, the failure to eliminate the violation threatened the termination of the contracts by the state body and, as a consequence, huge losses both for the enterprises themselves and for the entire construction industry of the region, which, in turn, would have had the most detrimental effect on the beginning and completion of construction of many houses, residential complexes, industrial and commercial bases, premises and structures.

Having taken these cases on board, we have studied all the details and circumstances and have developed a litigation strategy.

During court sessions, we faced great resistance from the defendants – state agencies represented by the district administration and the regional department.

In the end, after 1.5 months of tense court proceedings we managed to prove in court the rightness of our clients and cancel the orders of the state authorities.

As a result, the clients were able to continue their work unhindered and all the requirements of the state body were removed.
